§ 4.08.049. Exemptions from competitive selection.

  • A.

    The city council may grant an exemption from the competitive selection process by resolution or by motion. The following contracts are exempt from the competitive selection process upon a determination by the director of finance that the facts support the exemption:

    1.

    Contracts for labor or services rendered by any city officer or employee.

    2.

    Contracts for labor, material, supplies or services furnished by one city department to another department.

    3.

    Contracts with other governmental entities.

    4.

    Contracts for legislative liaison and lobbying services.

    5.

    Contracts relating to the acquisition, disposal or lease of real property.

    Contracts for labor, material, supplies or services for actual emergency work.

    B.

    Contracts may be exempted from the competitive selection process where a determination is made that the best interests of the city are served by a direct award of a contract without a competitive selection process. The city manager shall have the authority to make such an exemption for all contracts of less than $75,000, and the city council shall have the authority for all contracts of $75,000 or more.
