§ 12.13.061. No serving of alcohol without expanded license.

Notwithstanding a finding by the director to approve the serving of alcohol in a sidewalk dining area, no alcohol shall be served in the sidewalk dining area until an expansion of the on-sale alcoholic beverage license to the sidewalk dining area is approved pursuant to Division 9, commencing with Section 23000, of the California Business and Professions Code. The director's approval or failure to approve serving of alcohol in a sidewalk dining area shall be conveyed by the director to the Department of Alcoholic Beverage Control in response to any application by the permittee for the expansion to the sidewalk dining area of its on-sale alcoholic beverage license pursuant to Division 9, commencing with Section 23000, of the California Business and Professions Code.
