§ 10.53.050. Retrofitting.

    If all feasible routes to the requested terminal are found to be unsatisfactory by the traffic and transportation engineer, the applicant may request permission to retrofit the deficiencies. All costs of engineering, construction and inspection will be the sole responsibility of the applicant. Except when the retrofitting of deficiencies is within the jurisdiction of the California Department of Transportation, the actual construction will be done by the city or by a contractor approved in writing by the city.

    B.

    The applicant shall deposit the estimated cost of retrofitting, as determined by the traffic and transportation engineer, with the city. Any difference between the actual and the estimated cost shall be billed or refunded to the applicant.

    C.

    Should, at any time within 5 years from the date of completion of the retrofitting, another applicant seek terminal approval on a route which has already been retrofitted, such other applicant's fee may include a proportionate share of the earlier retrofitting, as determined by the traffic and transportation engineer. Such proportionate share may be disbursed by the city to the person or persons who paid for the original retrofitting.
